LOS ANGELES – A British Virgin Islands limited liability company is seeking more than $45 million from a California resident after the individual allegedly failed to purchase a painting.
Vigen Holdings LTD filed a complaint on Jan. 25 in the U.S. District Court for the Central District of California against Anitra Kyees alleging breach of contract and other counts.
According to the complaint, the plaintiff alleges that in January 2016, it was acting as an agent for the owner of a painting that was priced at $150 million. The suit states the defendant represented herself as an heiress and was identified as a purchaser of the painting. Kyees allegedly signed a letter confirming her intent to buy the painting in December 2016.
The plaintiff holds Kyees responsible because the defendant allegedly breached an agreement by failing to purchase the painting and by failing to schedule a viewing or authentication of the painting.
The plaintiff seeks judgment against defendant for actual damages in an amount no less than $45 million, plus punitive damages, costs of suit, attorney's fees, and further relief as the court deems just. It is represented by Aimée Scala of Cahill Cossu Noh & Robinson LLP in New York.
