LOS ANGELES — A Los Angeles County woman has filed a class action lawsuit against Spirit Airlines, alleging unfair competition.
Nikki Giavasis filed a complaint, individually and on behalf of all others similarly situated, Feb. 2 in U.S. District Court for the Central District of California against Spirit Airlines Inc. and Does 1-10, alleging they obtained profit through unfair or deceptive trade or commerce.
According to the complaint, Giavasis and other consumers have lost money or property from being deceived by Spirit to purchase airfare tickets that the defendant has misrepresented to be the lowest on the market.
The plaintiff alleges the defendants deceived consumers that Spirit's airfare is the lowest available, and failed to disclose the total cost of attendant services until after consumers have purchased their tickets.
Giavasis seeks trial by jury, an order certifying the class and appointing Giavasis as representative of the class, restitution and disgorgement of profits, corrective advertising, actual, punitive and statutory enhanced damages, attorney fees, court costs, interest and all other just relief.
