Disabled woman accuses Chula Vista property owners of disability discrimination

SAN DIEGO — A disabled California woman who requires a wheelchair, is suing Chula Vista property owners, alleging disability discrimination, failure to uphold Americans with Disabilities Act (ADA) regulations and violation of the Unruh Civil Rights Act.

Judy Magana filed a complaint Feb. 5 in U.S. District Court for the Southern District of California against Eastlake Design District LLC, SD Fly Ventures LLC, and Does 1-10, alleging they failed to provide full and safe equal access to its facilities for disabled persons.

According to the complaint, on several occasions in 2016 and 2017, Magana suffered difficulty and frustration, due to the discriminatory conduct of the defendants denying her full and equal access to their facilities at 851 Showroom Place, Suite 100, Chula Vista, including a non-working elevator that prevents her from visiting the upper floors. 

The plaintiff alleges the defendants failed to maintain their facilities in working and usable conditions to provide ready access to persons with disabilities, and deterred Magana from returning and patronizing the property because of the illegal barriers that exist.

Magana seeks trial by jury, actual damages and a statutory minimum of $4,000 per incident, injunctive relief, attorney fees, litigation expenses and costs of suit. She is represented by attorney Isabel Masanque of Center for Disability Access in San Diego.
