Penny Saver Liquor alleged to have failed to maintain parking space for disabled customers

LOS ANGELES – A Lawndale business is alleged to have failed to maintain a parking space designated for persons with disabilities.

Moises Reynoso filed a complaint on Feb. 5 in the U.S. District Court for the Central District of California against Elijah M Inc., doing business as Penny Saver Liquor, and Does 1-10 alleging violation of the Americans with Disabilities Act and other counts.

According to the complaint, the plaintiff alleges that on Sept. 2 and Oct. 10, 2017, he went to the liquor and grocery store owned by the defendants and encountered a number of barriers that interfered with his ability to use and enjoy the goods, services, privileges and accommodations offered therein. The suit states the plaintiff uses a wheelchair.

The plaintiff holds Elijah M Inc. and Does 1-10 responsible because the defendants allegedly failed to comply with the federal and state standards for the parking space designated for persons with disabilities and failed to maintain the parking space designated for persons with disabilities.

The plaintiff requests a trial by jury and seeks judgment against defendants for statutory, general and treble damages; preliminary and permanent injunction; restitution; attorney’s fees; litigation expenses; costs of suit and further relief as the court deems just. He is represented by Jason Yoon and John Y. Kim of So.Cal. Equal Access Group in Los Angeles.
