Fresno grain company accuses Global Natural of breach of contract

FRESNO — A Fresno County grain company is suing Global Natural, alleging breach of contract.

Penny Newman Grain Co. filed a complaint Feb. 5 in U.S. District Court for the Eastern District of California, Fresno Division against Global Natural LLC, alleging the defendant failed to pay more than $240,000. 

According to the complaint, on Feb. 3, 2017, and on March 23, 2017, Penny Newnan Grain entered into a contract agreement with defendant to sell and deliver organic cottonseed for which Global Natural agreed to pay the contract prices. Penny Newman Grain says it has performed all promises, covenants and conditions required under the agreement but it has failed to receive payment amounting to $241,455.25. 

The plaintiff alleges Global Natural has failed, neglected and refuses to pay in full for the organic cottonseed delivered.

Penny Newman Grain seeks trial by jury, damages of $241,455.25, prejudgment interest, attorney fees, costs of suit and all other relief the court deems just and proper. It is represented by attorney Bradley A. Silva of Law Offices of Bradley A. Silva in Fresno.
