Parlier enforcement officer accuses city of unpaid overtime wages

FRESNO — A Parlier enforcement officer has filed a class action lawsuit against the city, alleging unpaid overtime wages.

Adolfo Martinez Jimenez, on behalf of himself and all similarly situated individuals, filed a complaint Feb. 8,in U.S. District Court for the Eastern District of California, Fresno Division against the city of Parlier, alleging violation of the Fair Labor Standards Act.

According to the complaint, between March 2012 and January 2017, Jimenez was employed by the city as its only K-9 police officer. Jimenez says he routinely worked hours beyond the applicable FLSA threshold of 40 per week and in excess of his regularly scheduled hours. 

When the canine died, the suit says, the city of Parlier did not pay Jimenez for his time spent transporting, boarding, training, grooming, feeding, or otherwise caring for the dog while off duty.

The plaintiff alleges Parlier failed and refused to provide Jimenez with overtime compensation at a rate of one and one-half times his regular rate of pay. 

Jimenez seeks trial by jury, declaratory judgment, monetary damages, attorney fees, costs of action and all other relief the court deems just and proper. He is represented by attorneys Gary M. Messing, Jason H Jasmine and D. Paul Bird II of Messing Adam & Jasmine LLP in San Francisco.
