Disabled customer accuses Los Angeles liquor store owners of violating ADA

LOS ANGELES — A disabled man who requires a wheelchair is suing the owners of a Los Angeles liquor store, alleging disability discrimination and failure to uphold Americans with Disabilities Act regulations.

Francisco Garcia filed a complaint Feb. 14 in U.S. District Court for the Central District of California against Sucha, Birring Inc., doing business as Lucky 1 Liquor and Does 1-10, alleging failure to provide full and safe equal access to its facilities.

According to the complaint, on Aug. 2, and Sept. 25 2017, Garcia tried to use Lucky 1 Liquor, 1766 Firestone Blvd., Los Angeles. The suit says Garcia was denied the benefits of services, programs and activities of the defendants' building and facilities because of its disregard for ADA provisions. 

The plaintiff alleges the defendants failed to properly maintain the access aisles, and failed to provide the parking space identification sign with the international symbol of accessibility for wheelchair users.

Garcia seeks trial by jury, preliminary and permanent injunction, statutory, general and treble damages, restitution, attorney fees, litigation expenses, costs of suit, interest and all further relief the court deems just. He is represented by attorney Jason Yoon of So.Cal. Equal Access Group in Los Angeles.
