SAN DIEGO — A San Diego woman is suing an insurance company, alleging breach of contract.
Rebecca Schlesinger filed a complaint Feb. 14 in U.S. District Court for the Southern District of California against The Lincoln National Life Insurance Company, alleging violation of the Employee Retirement Security Act of 1974.
According to the complaint, in March 2013, Schlesinger started working for Berg Inc. The suit says at some time during her employment, she became disabled within the definition of her long-term disability policy. Despite making a claim in a timely fashion and being eligible for long-term disability under the policy, Schlesinger says she was denied benefits.
The plaintiff alleges Lincoln National Life Insurance has denied coverage under claims of ongoing long-term disability benefits despite Schlesinger being eligible and her constant appeal.
Schlesinger seeks trial by jury, coverage of past and ongoing long-term disability benefits, interest on past due benefits, attorney fees, costs of suit, and all other relief the court deems proper. She is represented by attorney Joshua M. Bonnici of Bonnici Law Group APC in San Diego.
