SAN DIEGO — The AAA is suing a Chula Vista tourist accommodation, alleging trademark infringement.
American Automobile Association, Inc. filed a complaint Feb. 15 in U.S. District Court for the Southern District of California against SSV Hospitality LLC, doing business as Chula Vista Inn, and Does 1 through 10, alleging violation of the Federal Service Mark Infringement.
According to the complaint, AAA trademarks are being illegally used by the defendant in conducting and promoting its business. The AAA says Chula Vista Inn is not authorized to use the AAA marks in connection with its goods or services as they are not affiliated with each other.
The plaintiff alleges Chula Vista Inn generated substantial sales and profits on advertising, sales and consumer recognition by using a registered trademark without consent.
The AAA seeks trial by jury, declaratory and injunctive relief, damages to exceed $500,000, plus punitive damages, attorney fees, pre- and post-judgment interest, cost and disbursements, and all further relief the court deems just and proper.
