LOS ANGELES — A disabled California man who requires a wheelchair is suing a Gardena company, alleging violation of the Americans With Disabilities Act (ADA), and the Unruh Civil Rights Act.
Rafael Arroyo Jr. filed a complaint Feb. 14 in U.S. District Court for the Central District of California against Jessal LLC and Does 1-10, alleging failure to provide full and safe equal access to its facilities.
According to the complaint, in December 2017, Arroyo was Jessal's property, 17414 S. Western Ave., Gardena, trying to rent a Dynasty Inn motel room. The suit says Arroyo suffered difficulty, discomfort or embarrassment from patronizing the defendants' motel due to a lack of facilities including parking spaces and access aisles.
The plaintiff alleges the defendants failed to make reasonable modifications in policies, practices, or procedures, failed to remove architectural barriers and failed to make alterations to provide access to disabled persons.
Arroyo seeks trial by jury, injunctive relief, actual damages and a statutory minimum of $4,000, attorney fees, litigation expenses and costs of suit. He is represented by attorney Isabel Masanque of Center for Disability Access in San Diego.
