SACRAMENTO — An employee has filed a class action lawsuit against a North Carolina-based company, alleging violation of the Fair Labor Standards Act (FLSA).
Mark Anderson filed a complaint, on behalf of himself and all others similarly situated, Feb. 12 in U.S. District Court for the Eastern District of California against Safe Streets USA LLC of Garner. North Carolina, and Does 1-100, alleging failure to provide employees their proper wages, benefits and incentives.
According to the complaint, Anderson, who worked for Safe Streets between October 2014 and December 2016, and other similarly situated employees have suffered loss of earnings for not being compensated for working additional hours in excess of 40 per week. The suit says Safe Streets failed to reimburse Anderson for expenses incurred for Internet access, cellphone usage and use of personal vehicles for work purposes.
The plaintiffs allege Safe Streets USA failed to pay overtime compensation, failed to provide proper rest periods and failed to reimburse employees for all expenses for the performance of their job.
Anderson and the other plaintiffs seek trial by jury, maintain the case as class action, compensatory and statutory damages, penalties and restitution, attorney fees, costs of suit, liquidated damages, interest and all further relief the court deems just.
