Customer accuses Kohl's of violating TCPA

SACRAMENTO — A customer is suing Kohl’s Department Stores, alleging violation of the Telephone Consumer Protection Act (TCPA).

Corrie Soltero filed a complaint Feb. 15, in the U.S. District Court for the Eastern District of California Sacramento Division against Kohl’s Department Stores Inc. and Does 1-100, alleging they violated TCPA through intrusive and unwanted phone calls.

According to the complaint, beginning in November 2017, Soltero has suffered from abuse and harassment, including invasion of privacy and intrusion on her seclusion, caused by Kohl's barrage of phone calls in an attempt to collect on an alleged debt from a 2011 loan. The suit says the calls have continued despite Soltero informing the defendants to contact her legal counsel instead. 

The plaintiff alleges the defendants continued to make calls despite her explicit demand to stop the improper calls, and unlawfully utilized an automatic telephone dialing system and/or an artificial or prerecorded voice.

Soltero seeks trial by jury, actual damages, statutory damages of $1,000, costs of litigation, attorney fees, statutory damages of $1,500 for every violation, and injunctive relief. She is represented by attorneys Scott J. Sagaria and Elliot W. Gale of Sagaria Law PC in Roseville.
