SACRAMENTO — A Rancho Dominguez tire business is suing a California competitor, alleging patent infringement.
Mobile Hi-Tech Wheels filed a complaint Feb. 12 in U.S. District Court for the Eastern District of California against TWM Wholesale LLC and Tire & Wheel Master Inc., et al, alleging the defendants obtained profit and good will through infringement.
According to the complaint, Mobile Hi-Tech Wheels was irreparably damaged as a result of the defendants' unlawful conduct in offering for sale vehicle wheels with substantially similar designs to that of the plaintiff's patents ’133, ’138, ’241 and ’136.
The plaintiff alleges the defendants created or developed derivative works from Mobile Hi-Tech's patented design without consent from the plaintiff, and received money and profits that rightfully belong to plaintiff.
Mobile Hi-Tech Wheels seeks trial by jury, judgment against the defendants enjoining them from selling the infringing products, damages covered by the acts of patent infringement, prejudgment interest, costs of action, attorney fees and all further relief the court deems just.
