Man alleges Sacramento Starbucks shop did not have accessible transaction counters

SACRAMENTO – A patron at a Starbucks in Sacramento alleges that the shop does not have accessible facilities for disabled patrons.

Scott Johnson filed a complaint on Feb. 21 in the U.S. District Court for the Eastern District of California against Starbucks Corp. and Does 1-10 alleging violation of the Americans with Disabilities Act and the Unruh Civil Rights Act.

According to the complaint, the plaintiff is a quadriplegic and uses a wheelchair and a specially equipped van. He alleges during multiple visits in 2017, he suffered frustration and difficulty and was discriminated against due to the lack of accessible facilities at defendants' coffee shop on Florin Road in Sacramento.

The plaintiff holds Starbucks Corp. and Does 1-10 responsible because the defendants' shop allegedly did not have accessible, compliant transaction counters in violation of the ADA.

The plaintiff seeks judgment against the defendants, injunctive relief, actual damages and a statutory minimum of $4,000, attorneys' fees, litigation expenses and costs of suit. He is represented by Isabel Masanque, Mary Melton, Phyl Grace and Dennis Price of Center for Disability Access in San Diego.
