LOS ANGELES — A retirement fund's board of trustees is suing a printing business, alleging violation of the Employee Retirement Income Security Act (ERISA).
GCIU-Employer Retirement Fund, and theBoard of Trustees of the GCIU-Employer Retirement Fund filed a complaint Feb. 27 in U.S. District Court for the Central District of California against ABCO Printing, doing business as RP Enterprises LLC, alleging violation of ERISA through non-payment of plan benefits.
According to the complaint, the plaintiffs have suffered damages from the defendant's breaching of the trust agreement by not providing the plaintiffs with the requisite books and records or the necessary payment obligation.
The plaintiffs allege RP Enterprises failed to make payments pursuant to the four payment schedules as required, and failed to cure the required withdrawal liability payments.
The plaintiffs seek trial by jury, a past due withdrawal liability payment of $1,062,098, plus interest, attorney fees, costs of action and all equitable relief the court deems appropriate.
