Disabled customer accuses Fresno car repair shop of disability discrimination

SACRAMENTO  — A disabled man who requires a wheelchair for mobility is suing a Fresno car repair shop, alleging disability discrimination and failure to uphold Americans with Disabilities Act (ADA) regulations.

Jose Acosta, who has filed numerous disability discrimination suits, filed a complaint March 2 in U.S. District Court for the Eastern District of California against JL Ink, doing business as Francis Collision Center and JJ McKinley, alleging they denied full access to the physically disabled.

According to the complaint, on June 29, 2017, Acosta went to Francis Collision Center, 2420 E. McKinley Ave., Fresno, to have his car fixed. The suit says Acosta suffered difficulty and frustration from visiting the defendants' business premises, due to personally encountering architectural barriers that prevented him from enjoying the same goods, services and accommodation as other consumers. 

The plaintiff alleges the defendants failed to make reasonable modifications in policies, practices, or procedures at the facility, and failed to maintain in operable working condition the features of the facility so it could be used by disabled persons.

Acosta seeks trial by jury, statutory minimum damages, attorney fees, litigation expenses, costs of suit, interest, injunctive relief, preventive relief and any other relief the court deems proper. He is represented by attorney Zachary M. Best of Mission Law Firm APC in San Jose.
