LOS ANGELES — A store clerk is suing Dollar Tree, alleging unpaid wages.
Nora Gonzalez filed a complaint March 1 in U.S. District Court for the Central District of California against Dollar Tree Stores Inc., alleging violation of the Fair Labor Standards Act for unlawful non-payment of overtime compensation to non-exempt employees.
According to the complaint, for four years Gonzalez worked more than 40 hours per week as a Dollar Tree employee in a non-administrative, executive or professional capacity and she spent more than 50 percent of her time in activities not directly or closely related to managerial duties. Gonzalez says within her four years of employment, she was not provided with proper wages, overtime compensation, meal and rest periods required under a non-exempt employee as required by FLSA.
The plaintiff alleges Dollar Tree Stores failed to properly pay wages, overtime wages, provide meal periods, rest periods and failed to keep written contracts for employment.
Gonzalez seeks trial by jury, unpaid wages, all applicable penalties, injunctive relief, court costs, and all other relief the court deems just and proper. She is represented by Mike Arias, Alfredo Torrijos and Craig S. Momita of Arias, Sanguinetti, Wang & Torrijos LLP in Los Angeles.
