Disabled customer accuses Whittier property owner of disability discrimination

LOS ANGELES — A disabled California man who requires a wheelchair for mobility is suing a Whittier property owner, alleging disability discrimination.

Rafael Arroyo Jr. filed a complaint March 2 in U.S. District Court for the Central District of California against Mark Troughton, Mobile Computer Solutions Corporation and Does 1-10, alleging violations of the American’s With Disabilities Act and the Unruh Civil Rights Act.

According to the complaint, in January, Arroyo went to Mobile Computer Solutions, 14454 Whitter Blvd., Whittier. The suit says Arroyo encountered difficulty accessing the parking lot because there were no parking spaces marked and reserved for persons with disabilities. The lawsuit states this denied Arroyo full and equal access, causing him difficulty, discomfort and embarrassment. 

The plaintiff alleges the defendants failed to maintain in operable working condition the features of facilities and equipment required to be readily accessible to and usable by persons with disabilities at a business establishment.

Arroyo seeks trial by jury, injunctive relief, actual damages and a statutory minimum of $4,000, attorney fees, litigation expenses and costs of suit. He is represented by attorney Chris Carson of Center for Disability Access in San Diego.
