Pennsylvania business seeks return of $625,000 in property deal

LOS ANGELES — A Pennsylvania company is suing a New York business, alleging breach of contract in a property transaction.

Bronx Webster LLC of Newtown Square, Pennsylvania, filed a complaint March 5 in U.S. District Court for the Central District of California against Behavioral Property Partners LLC of Ellenville, New York, and Michael R. Treanor alleging the defendants owe more than $600,000. 

According to the complaint, on Dec. 15, 2017, Bronx Webster and the defendants signed a binding letter agreement for the plaintiff regarding the purchase and sale of a property at 1964 Los Canoas Road, Santa Barbara, California. Under the agreement, Bronx Webster says it has fulfilled and performed all of its contractual obligations by depositing $500,000 as required under the contract. 

Despite diligent efforts, the suit says, the defendants have refused to negotiate and sign an agreement of sale and lease for the property. 

The plaintiff alleges Behavioral Property Partners and Treanor have failed and refused to return to Bronx Webster the $500,000 deposit, plus a $125,000 premium. The suit says the defendants have failed to negotiate diligently and in good faith and failed to sign an agreement of sale and lease for the Santa Barbara property and failed to close the purchase and sale of the property.

Bronx Webster seeks trial by jury, payment of $625,000, plus interest, court costs, and any other relief the court deems proper. It is represented by attorney Henry L. Whitehead of Fox Rothschild LLP in Los Angeles.
