SACRAMENTO – A debt collector is alleged to have harassed a Sacramento County consumer with collection calls.
Netia Mack filed a complaint individually and on behalf of all others similarly situated on March 2 in the U.S. District Court for the Eastern District of California against Western Dental Services Inc. and Does 1-10 citing the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that starting September 2017, Western Dental Services began contacting her in an effort to collect an alleged debt. She alleges the defendant did not have her permission to contact her and that it continued to contact her after she revoked her consent to be called.
The plaintiff holds Western Dental Services Inc. and Does 1-10 responsible because the defendants allegedly caused a telephone to ring repeatedly or continuously annoy her and communicated with such frequency to constitute harassment.
The plaintiff requests a trial by jury and seeks judgment against the defendants, award actual and statutory damages, costs and attorney’s fees, and further relief as may be just.
