SACRAMENTO – A Guernville man alleges a medical device used in a hernia surgery failed and caused him injury.
Terry Hansen filed a complaint on March 7 in the U.S. District Court for the Eastern District of California against Davol Inc. and C.R. Bard alleging strict liability, negligence and other counts.
According to the complaint, the plaintiff alleges that in October 2013, he underwent an inguinal hernia repair using the defendants' mesh product. He alleges the product was removed in February 2017 because it failed.
The plaintiff holds Davol Inc. and C.R. Bard responsible because the defendant allegedly failed to properly design and/or manufacture product, failed to adequately warn plaintiff’s physicians of the numerous risks, and failed to provide adequate warnings and instructions concerning the risks associated with using the product.
The plaintiff requests a trial by jury and seeks judgment against defendants, award of compensatory and punitive damages, restitution and disgorgement of profits, attorneys’ fees, costs of suit, economic damages, interest and further relief as the court deems just.
