SAN FRANCISCO – A San Francisco apartment building owner alleges she has suffered damages as a result of work done by a contractor.
June L. Paoli, doing business as JL Paoli & Co., filed a complaint on March 5 in the San Francisco County Superior Court against Michael White, doing business as MW General Contracting Inc., et al. alleging breach of contract, negligence and damage to real property.
According to the complaint, the plaintiff contracted the defendants to remove six steel deck guardrails at the plaintiff's property and replace them with new railings that comply with code. She alleges less than one year after the railings were installed, the paint is peeling and has caused corrosion and rusting.
The plaintiff holds White, et al. responsible because the defendants allegedly failed to fulfill their contractual obligations to satisfactorily perform the paint and replacement work and failed to honor one-year guarantee of all labor and building materials.
The plaintiff requests a trial by jury and seeks judgment against defendants, an award of general damages, diminution in value, compensatory damages, attorney's fees, costs and further relief as the court may deem proper.
