Tenant of Peralta Street property alleges mold problems were not addressed

SAN FRANCISCO – A tenant is seeking damages from her landlords over their alleged failure to abate a mold problem in the unit she rented.

Kaitlin Wright filed a complaint on March 6 in the San Francisco County Superior Court against Miles Grant Ito, Jeff Knowles, Clinton Hayes and Does 1-50 alleging breach of contract, negligence and other counts.

According to the complaint, the plaintiff rented a unit from the defendants on Peralta Street in San Francisco in 2015. She alleges she had to vacate the property because of mold. She alleges she became physically ill with toxic mold syndrome and suffered severe emotional distress as a result of the negligence of the defendants to provide habitable and safe dwellings for their tenants. 

The plaintiff holds Ito, Knowles, Hayes and Does 1-50 responsible because the defendants allegedly failed to remedy the pervasive mold problems in plaintiff's unit and failed to adequately maintain and manage the premises and the unit.

The plaintiff requests a trial by jury and seeks judgment against defendant for general and special damages, attorney's fees, statutory and punitive damages, and all other relief as the court deems just. She is represented by Siofra M. Byrne of Law Office of Siofra M. Byrne in San Francisco.
