Tenants of San Francisco property allege owner, manager breached contract

SAN FRANCISCO – Two tenants are suing their landlord and property manager over renovations to the downstairs unit of the property.

Salina Monti & Edward Pitcher filed a complaint on March 6 in the San Francisco County Superior Court against Francis Osman Vincent, C. Cournale & Co. Inc. and Does 1-10 alleging breach of contract and other counts.

According to the complaint, the plaintiffs have rented the upper unit of a two-story 30th Avenue, San Francisco property from Vincent for 10 years. The suit states C. Cournale is the property manager.

The plaintiffs allege that they suffered emotional distress as a result of the wrongful conduct of the defendants performing renovations on the lower unit of property without the necessary permits.

The plaintiffs hold Vincent, C. Cournale & Co. Inc., and Does 1-10 responsible because the defendants allegedly violated San Francisco code by undertaking construction in an unpermitted and unworkmanlike fashion, interfering with the plaintiffs' right to quiet use and enjoyment of a rental unit and failed to provide a habitable dwelling.

The plaintiffs request a trial by jury and seek judgment against defendants, award of compensatory and special damages, costs of suit, attorney's fees. They are represented by Ian Kelley of Law Offices of Ian Kelley in San Francisco.
