Wheelchair user alleges Amgro Fertilizer & Farm Supply store lacks accessible parking

FRESNO – A Fresno farm supply store is alleged to have violated accessibility guidelines by failing to remove architectural barriers.

Jose Acosta filed a complaint on March 16 in the U.S. District Court for the Eastern District of California against Amgro Farm Service Inc., doing business as Amgro Fertilizer & Farm Supply, et al. alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff is a wheelchair user and he visited the defendants' Fresno store on Nov. 26, 2017, to purchase fertilizer. He alleges that he encountered barriers there that interfered with his ability to use the accommodations there, including a lack of accessible parking, pathways and restroom facilities. 

The plaintiff holds Amgro Farm Service Inc., et al. responsible because the defendants allegedly failed to remove the architectural barriers and failed to design or alter its facility to make it accessible.

The plaintiff seeks injunctive relief, attorney's fees and any other relief as the court deems proper. He is represented by Zachary M. Best of Mission Law Firm APC in San Jose.
