Luminence alleges Glow With Us used photo without authorization

SAN DIEGO – A La Puente company is alleged to have unlawfully used a La Jolla corporation's copyrighted photo on its products.

Luminence LLC filed a complaint on March 26 in the U.S. District Court for the Southern District of California against Glow With Us Inc. alleging copyright infringement.

According to the complaint, the plaintiff creates lighted, fiber-optic accessories under the Glowbys name and has copyrighted photos of models wearing the accessories.

It alleges the defendant sells competing products and that the packaging on those products uses one of the plaintiff's copyrighted photos. The plaintiff alleges it has never authorized the defendant to use the photo.

The plaintiff seeks judgment against defendant for award of actual damages, costs of action, interest, destroy all copies, and further relief as the court may deem just. It is represented by Matthew H. Capron of Capron Law Offices in Chula Vista.
