SAN DIEGO – A San Diego County consumer alleges he was unlawfully contacted by the marketing arm for a cruise ship operator.
John W. Davis filed a complaint on March 25 in the U.S. District Court for the Southern District of California against BPCL Management LLC, formerly known as Bahamas Paradise Cruise Line LLC and doing business as Bahama Island Cruises, and Does 1-100 alleged violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that on March 22, the defendant sent a pre-recorded call to his phone using neighbor spoofing to promote its services. The suit states neighbor spoofing is "a new form of number spoofing that attempts to match the recipients' telephone number to trick the recipient into answering the call."
The plaintiff holds BPCL Management LLC and Does 1-100 responsible because the defendants allegedly called plaintiff without express consent and invaded plaintiff's rights to privacy and seclusion.
The plaintiff requests a trial by jury and seeks judgment against defendant for declaratory and injunctive relief, award of actual and statutory damages, and other relief the court deems reasonable and just. He is representing himself.
