LOS ANGELES – A Glendale business is alleged to not have accessible parking for customers with physical disabilities.
Chris Langer filed a complaint on March 27 in the U.S. District Court for the Central District of California against Lillie Sue Makhanian, Howard George Chen and Does 1-10 alleging violation of the Americans with Disabilities Act and the Unruh Civil Rights Act.
According to the complaint, the plaintiff is a paraplegic and uses a wheelchair. He alleges that in February, he went to Legacy Comics and Cards and Heritage Eatery to shop and eat. He alleges the location, which is owned by the defendants, does not have a single parking space marked for persons with disabilities.
The plaintiff holds Makhanian, Chen and Does 1-10 responsible because the defendants allegedly violated the ADA by failing to provide accessible parking spaces.
The plaintiff seeks judgment against defendants for injunctive relief, actual damages and a statutory minimum of $4,000, attorney's fees, litigation expenses and costs of suit. He is represented by Chris Carson, Raymond Ballister Jr., Phyl Grace and Dennis Price of Center for Disability Access in San Diego.
