Customer alleges Robeks Fresh Juices & Smoothies location did not have compliant parking

LOS ANGELES – A wheelchair user alleges a Long Beach smoothie and juice store has barriers that interfered with his ability to enjoy the services there.

Richard Powell filed a complaint on April 2 in the U.S. District Court for the Central District of California against Robeks Corp., doing business as Robeks Smoothies Juices Frozen Yogurt No. 1, and Does 1-10 citing the Americans with Disabilities Act and the Unruh Civil Rights Act.

According to the complaint, the plaintiff alleges that on July 13 and Sept. 5, 2017, he visited the defendants' location in Long Beach. He alleges the defendants failed to maintain a parking space for persons with disabilities.

The plaintiff requests a trial by jury and seeks judgment against defendants; award of statutory, general and treble damages; restitution; attorney’s fees; litigation expenses; and costs of suit; interest; and further relief as the court deems just. He is represented by Kevin Hong of Advanced Disability Advocates in Los Angeles.
