SAN DIEGO – A San Diego woman alleges that a debt collector used misleading representations in an attempt to collect an alleged debt.
Aviva Betech filed a complaint on behalf of herself and similarly situated class members on April 13 in the U.S. District Court for the Southern District of California against The Judge Law Firm ALC and The Grande North at Santa Fe Place Homeowners Association citing the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that the Judge Law Firm contacted her in an attempt to collect an alleged debt owed to The Grande North at Santa Fe Place Homeowners Association. She alleges the letter she received from the defendants "threatened" to charge her for additional correspondence and collection costs not yet accrued.
The plaintiffs hold The Judge Law Firm ALC and The Grande at Santa Fe Place Homeowners Association responsible because the defendants allegedly used false, deceptive or misleading representation to collect an alleged debt.
The plaintiffs request a trial by jury and seek judgment against defendants, award actual damages, statutory damages of $1,000, costs of litigation, attorney’s fees, and other relief the court should deem just. She is represented by Joseph Z. Samo of Samo Law Group in San Diego.
