FRESNO – A Fresno store is alleged to have discriminated against a customer who uses a wheelchair by not having an accessible facility.
Jose Acosta filed a complaint on April 13 in the U.S. District Court for the Eastern District of California against Eric Santillan, doing business as Mr Mango Antojitos Mexicanos, and Olman Ayala LLC citing the Americans with Disabilities Act.
According to the complaint, the plaintiff uses a wheelchair and visited the defendants' facility on Feb. 7 to purchase snacks. He alleges he could not find a designated accessible parking stall in the parking area and that he could not find any accessible entrances. The suit states there was a step at the entrance door that he could not wheel over.
The plaintiff holds Santillan and Olman Ayala LLC responsible because the defendants allegedly discriminated against him by denying him full and equal enjoyment of the facility.
The plaintiff seeks judgment against defendants, injunctive and preventive relief, or any other relief the court deems proper, statutory minimum damages, attorneys' fees, litigation expenses, and interest. He is represented by Zachary M. Best of Mission Law Firm APC in San Jose.
