BASF Corp. alleges Visalia body shop breached agreement, owes thousands

FRESNO – A Visalia body shop is alleged to owe more than $800,000 to a New Jersey paint supplier.

BASF Corp. filed a complaint on April 16 in the U.S. District Court for the Eastern District of California against Cesare's Collision Repair & Towing Inc., also known as or doing business as Cesare's Collision Repair Center & Towing, alleging breach of contract and other counts.

According to the complaint, the plaintiff sells aftermarket paints, coatings, primers and other items and in February 2014, the parties entered into an agreement. The suit states that the agreement required the defendant to fulfill 100 percent of its requirements for Refinish products up to a minimum purchase requirement of $743,000.

The suit states the defendant terminated the agreement in June 2014 without any justification, failed to meet its minimum purchase requirements under the agreement and failed to pay plaintiff the amounts due and owing.

The plaintiff requests a trial by jury and seeks judgment against defendant, award of monetary damages in an amount no less than $823,000, plus interest, costs, fees, and further relief as the court deems just.
