Long Beach woman alleges debt collector called mother, said it was calling regarding job application

LOS ANGELES – A Long Beach consumer alleges a debt collector unlawfully called family members and misrepresented the reason it was calling.

Courtney Daliva filed a complaint on April 10 in the U.S. District Court for the Central District of California Western Division against IQ Data International Inc. over alleged violation of the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that she and her family members were contacted by defendant in an attempt collect a debt from her. She alleges the defendant contacted her mother and her girlfriend's mother and allegedly misrepresented that it was calling in reference to a job application that she submitted or a personal business matter. 

As a result of defendant's calls, Daliva alleges she suffered significant amount of stress, anxiety and embarrassment. 

The plaintiff holds IQ Data International Inc. responsible because the defendant allegedly used false, deceptive, or misleading representations or means in connection with the collection of a debt by contacting family members for the purpose of locating her.

The plaintiff requests a trial by jury and seeks actual and statutory damages of $1,000, costs of litigation and reasonable attorneys’ fees, punitive damages, such other and further relief as may be just and proper. She is represented by Trinette G. Kent of Lemberg Law LLC in Wilton, Connecticut.
