SACRAMENTO – An Exeter resident alleges a debt collector continued to call him after he sent a letter asking it to stop.
Brian Neufeld filed a complaint on April 25 in the U.S. District Court for the Eastern District of California against Financial Credit Network Inc. alleging violation of the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, a debt allegedly owed by the plaintiff was assigned or transferred to the defendant for collection in January. The plaintiff alleges on Jan. 16, he mailed a letter to the defendant to inform it to stop contacting him via telephone, but the defendant continued to call.
The plaintiff holds Financial Credit Network Inc. responsible because the defendant allegedly violated certain portions of the federal FDCPA.
The plaintiff requests a trial by jury and seeks judgment against defendant, award of actual damages, statutory damages of $1,000, costs of litigation, and attorney’s fees. He is represented by Crosby S. Connolly and Robert L. Hyde of Hyde & Swigart in San Diego.
