Leadpages alleged to have harassed man with unwanted text messages

SAN DIEGO – A San Diego man alleges that a marketing company sent him text messages without his consent.

Jake Tiffany filed a complaint individually and on behalf of all others similarly situated on April 16 in the U.S. District Court for the Southern District of California against Avenue 81, doing business as Leadpages, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he received unsolicited text messages from the defendant beginning in March 2017 advertising its services. He alleges he had no prior relationship with the defendant.

The plaintiff holds Avenue 81 responsible because the defendant allegedly invaded his privacy and harassed him with text messages.

The plaintiff requests a trial by jury and seeks judgment against defendant, $500 in statutory damages for each and every violation, $1,500 in statutory damages for each and every willful violation and other relief the court may deem just.
