LOS ANGELES – A Los Angeles man alleges a debt collector is attempting to collect on a disputed debt.
David C. Marks filed a complaint on April 30 in the U.S. District Court for the Central District of California against Transworld Systems Inc. and Does 1-10 citing the Fair Debt Collection Practices Act and the Rosenthal Act.
According to the complaint, the plaintiff alleges that on Jan. 10, the defendant sent him a collection letter and that he wrote back disputing the debt and asking the defendant to cease communication four days later. The suit states that the defendant "ignored" his request and instead replied back as if he had requested validation of the debt.
The plaintiff holds Transworld Systems Inc. and Does 1-10 responsible because the defendants allegedly attempted to collect an amount not authorized by law or the loan agreement.
The plaintiff requests a trial by jury and seeks judgment against defendants for statutory and actual damages, costs, attorney's fees, general damages and further relief as the court deems just. He is represented by Aidan W. Butler in Los Angeles.
