Consumer claims Capital One Bank did not have consent to call him for collection purposes

LOS ANGELES – A Monrovia, California resident alleges a debt collector called him more than 100 times after he asked for the calls to cease.

Jarrod Green filed a complaint on April 30 in the U.S. District Court for the Central District of California against Capital One Bank (USA) NA over alleged violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he received collection calls from the defendant seeking and attempting to collect on alleged debts incurred through purchases made on credit issued by defendant. The plaintiff alleges the calls were placed with an automated dialing system and were not for emergency purposes and made with no prior express consent.

The plaintiff alleges on Oct. 12, 2017, he contacted the defendant and requested that the collection calls stop, but the defendant has made 180 calls since that request.

The plaintiff requests a trial by jury and seeks actual and compensatory damages, costs, attorneys' fees and any other relief the court deems appropriate. He is represented by Alyson Dykes of The Law Offices of Jeffrey Lohman PC in Corona.
