Dodge Charger owners allege vehicle developed defects while still under warranty

SAN FRANCISCO – A Los Angeles County couple alleges a vehicle they purchased developed defects while still under warranty.

Brian Tyler Smith and Lorraine Anne Smith filed a complaint on April 30 in the San Francisco County Superior Court against FCA US LLC, Stockton Dodge Inc. and Does 1-10 alleging breach of express written warranty and other counts.

According to the complaint, the plaintiffs allege that on June 25, 2012, they purchased a 2012 Dodge Charger that came with an express written warranty. They allege that while the vehicle was still under warranty, the vehicle developed defects relating to the airbag system, shifter, alternator, air conditioning system and other defects that impaired the use, value or safety of the vehicle. 

The plaintiffs hold FCA US LLC, Stockton Dodge Inc. and Does 1-10 responsible because the defendants allegedly failed to service or repair the vehicle so as to conform to warranties.

The plaintiffs request a trial by jury and seek judgment against defendants for actual damages, restitution, civil penalty, consequential and incidental damages, costs of suit, attorneys' fees, interest and other relief as the court may deem proper. They are represented by Jacob Cutler and Tionna Dolin of Strategic Legal Practices APC in Los Angeles.
