Pedestrian seeks damages after he was struck in San Francisco crosswalk

SAN FRANCISCO – A pedestrian is seeking damages from a motorist who allegedly failed to yield and struck him while walking in a San Francisco crosswalk.

Oscar Gonzalez Mercado filed a complaint on May 1 in the Superior Court of the State of California against Jerold Garibaldi alleging negligence.

According to the complaint, the plaintiff alleges that on May 18, 2016, he was a pedestrian crossing in a crosswalk when he was allegedly struck by defendant's motor vehicle. As a result, Mercado claims he sustained physical injuries that left him liable for hospital and medical expenses. 

The plaintiff holds Garibaldi responsible because the defendant allegedly failed to exercise caution while driving his motor vehicle in that he failed to stop or yield the right of way.

The plaintiff seeks judgment for compensatory damages according to proof. He is represented by Shawn S. Salehieh of Presidio Law Group APC in San Francisco.
