Licensed Slayer merchandise distributor seeks order against 'unlicensed peddlers' at concerts

Trademark 09

SAN DIEGO – The licensed distributor for merchandise for the band Slayer is seeking to stop the sales of unauthorized, bootleg merchandise at concerts on the band's current U.S. tour.

Global Merchandising Services LTD filed a complaint on May 4 in the U.S. District Court for the Southern District of California against various John Does, Jane Does and ABC companies alleging trademark infringement.

According to the complaint, the plaintiff alleges that the musical group Slayer has used the Slayer trademark since 1983 to identify itself and granted the plaintiff the exclusive right to market merchandise.

The plaintiff alleges the defendants are "numerous independent unlicensed peddlers and manufacturing companies who will be attempting to distribute and sell unauthorized bootleg and inferior merchandise" with the Slayer name at the group's concerts while on its current tour.

The plaintiff seeks judgment against defendants, for the court to issue a temporary restraining order and a preliminary injunction, an order for law enforcement to seize and impound infringing merchandise, permanent injunction, and further relief that the court deems to be reasonable. It is represented by Kenneth A. Feinswog in Culver City.
