SAN DIEGO – A consumer alleges a debt collector failed to tell her that calls were being recorded.
Brenda White filed a complaint on May 7 in the U.S. District Court for the Southern District of California against Atlantic Credit & Finance Inc., doing business as Receivables Billing International, and Does 1-10 alleging violation of the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that beginning in May 2017, the defendant began contacting her in an attempt to collect an alleged debt. She alleges the defendant failed to disclose that the calls were recorded and threatened to pursue legal action that it has not taken.
The plaintiff holds Atlantic Credit & Finance Inc. and Does 1-10 responsible because the defendants allegedly used unfair and unconscionable means to collect an alleged debt.
The plaintiff requests a trial by jury and seeks judgment against defendant; award of actual, statutory and treble damages; costs of litigation; attorney's fees and other relief the court should deem just. She is represented by Joshua B. Swigart of Hyde & Swigart APC in San Diego.
