SAN DIEGO – A disabled Florida man alleges he encountered barriers at two La Jolla properties.
Jose Velez filed a complaint on April 30 in the U.S. District Court for the Southern District of California against Mandarin House of La Jolla Inc., The Bed & Breakfast Inn at La Jolla and Does 1-10, alleging violation of the Americans with Disabilities Act and Unruh Civil Rights Act.
According to the complaint, the plaintiff has mobility-related limitations because of his disabilities. The plaintiff alleges that on March 28, he visited defendants' facilities and allegedly encountered architectural barriers that denied him full and equal access to the premises.
The plaintiff holds Mandarin House of La Jolla Inc., The Bed & Breakfast Inn at La Jolla and Does 1-10 responsible because the defendants allegedly failed to remove the barriers and failed to make alterations.
The plaintiff seeks injunctive relief, actual damages, statutory damages of $4,000, plus punitive damages, attorney's fees and costs of suit. He is representing himself.
