LOS ANGELES – A patron of a La Habra restaurant alleges there are barriers there that restrict access to individuals like him who use a wheelchair.
Stephen Turner filed a complaint on May 7 in the U.S. District Court for the Central District of California against TS Burger Inc. alleging violation of the Americans with Disabilities Act and the Unruh Civil Right Act.
According to the complaint, the plaintiff alleges that in February, March and April of this year, he went to patronize defendant's business when he allegedly encountered barriers that interfered with his ability to use and enjoy the goods, services and accommodations offered at the facility. He alleges that the service counter is too high at the property and the restroom is not configured for patrons with disabilities.
The plaintiff requests a trial by jury and seeks statutory damages of $4,000, reasonable statutory attorney fees, litigation expenses, costs, prejudgment interest and such other and further relief as this court may deem just and proper.
