Man names Bank of the West, credit bureaus in suit over alleged inaccurate info on credit reports

SACRAMENTO – A consumer alleges that there is inaccurate information on his credit reports.

Harlan Hoyt filed a complaint on May 18 in the U.S. District Court for the Eastern District of California against Experian Information Solutions Inc., Equifax Information Services LLC, Bank of the West and Does 1-100 alleging violation of the Fair Credit Reporting Act and the California Consumer Credit Reporting Agencies Act.

According to the complaint, the plaintiff alleges that Bank of the West is reporting rolling charge offs on his account beginning in June 2016 when one was a one-time event. He also alleges Experian and Equifax are reporting that the plaintiff filed for bankruptcy protection in October 3020 and not the actual date of Nov. 30, 2009.

The plaintiff holds Experian Information Solutions Inc., Equifax Information Services LLC, Bank of the West and Does 1-100 responsible because Experian and Equifax allegedly failed follow reasonable procedures to assure maximum possible accuracy in the preparation of plaintiff’s credit reports and credit files and Bank of the West failed to conduct a reasonable investigation.

The plaintiff requests a trial by jury and seeks judgment against defendants for injunctive relief; statutory, actual and punitive damages; attorney's fees; and costs of suit. He is represented by Scott J. Sagaria, Elliot W. Gale, Joe B. Angelo and Scott M. Johnson of Sagaria Law PC in Roseville.
