Former tenants allege San Francisco property has exposed wires, raw sewage leak

SAN FRANCISCO – Former tenants of a San Francisco property allege the property owners failed to keep the unit in a habitable condition.

Freddy Morataya and Marly Orozco filed a complaint on May 15 in the Superior Court of the State of California against Brenda Paz, Chen Han Yao and Does 1 through 50 alleging breach of contract, negligence and other counts.

According to the complaint, the plaintiffs allege that in 2017, they entered into written lease agreement with defendants for a property on Hollister in San Francisco. They allege the property has exposed wires, mold, a cockroach infestation, unfinished electrical work and gasses from a raw sewage leak are present. 

The plaintiffs hold Paz, Yao and Does 1 through 50 responsible because the defendants allegedly failed to maintain the unit in a habitable condition.

The plaintiffs request a trial by jury and seek judgment for general and special damages, statutory damages, attorney's fees, punitive damages and for any all other relief that the court deems proper and just. They are represented by Edward M. Higginbotham, Conrad K. Wu and Ian B. Kelly of Edward M. Higginbotham in San Francisco.
