FRESNO – A Kern County man alleges he was not paid the appropriate rate for overtime work during his employment with a Fresno County business.

Joselito Andrada filed a complaint on May 9 in the Fresno County Superior Court against Bee Sweet Citrus Inc. and Does 1 to 50 over alleged violation of California law and Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was an employee for the defendant for about eight years and was paid a salary of $17 an hour. He alleges he was paid the same rate for overtime work.

The plaintiff holds Bee Sweet Citrus Inc. and Does 1 to 50 responsible because the defendant allegedly failed to pay him at a rate of one-and-a-half times his regular rate for work in excess of 40 hours in one workweek and failed to pay him all final wages, including all unpaid overtime wages and unpaid meal and rest break premiums, within 72 hours of his resignation in August 2017.

The plaintiff requests a trial by jury and seeks judgment for costs of suit, attorney's fees, civil and statutory penalties, prejudgment interest, and for such other and further relief as the court may deem proper. He is represented by Ben Rothman of Law Office of Ben Rothman in Santa Monica.
