Man alleges city of Fowler's fees for public records request are 'exorbitant'

FRESNO – A Kings County man alleges a California city is charging him "exorbitant" fees for public records.

David Weisser filed a complaint on May 10 in the Fresno County Superior Court against the city of Fowler and Does 1-10 citing the California Public Records Act.

According to the complaint, the plaintiff alleges that in numerous times in 2017, he requested records from the defendant that pertained in any way to communications and/or negotiations with him. He alleges that the city is requiring him to pay $35,000 for electronic records and 50 cents per page for physical records prior to making them available to him. 

The plaintiff is seeking a judicial determination that the defendant's assessment and imposition of fees are unlawful under the Public Records Act.

The plaintiff requests a trial by jury and seeks seek injunction ordering city to make the records available immediately at a reduced expense and for such other and further relief as the court deems just and proper. He is represented by Leonard C. Herr and Rhea Ikemiya of Herr Pedersen & Berglund LLP in Visalia.
