Man alleges metal stake struck him while mowing Fresno property

FRESNO – A man is seeking damages from the owners of a property after he was struck by a metal stake while mowing.

Fernando Santoya filed a complaint on May 10 in the Fresno County Superior Court against Florencio C. Valenzuela, Mercy S. Valenzuela, Ruben Valenzuela, Arthur Valenzuela and Does 1 to 100 alleging negligence and failure to warn.

According to the complaint, the plaintiff alleges that on May 11, 2016, he was lawfully cutting grass on defendants' premises in Fresno when suddenly and without notice a metal stake was propelled into his leg. 

As a result, Santoya claims he suffered severe injuries for which he received reasonable and necessary medical care and treatment. 

The plaintiff holds the defendants responsible because the defendants allegedly failed to address, alleviate, remove and/or remedy the dangerous condition.

The plaintiff seeks compensatory damages and demands relief of more than $25,000. He is represented by Daniel D. Geoulla of B&D Law Group, APLC in Los Angeles.
