Cyclist alleges debris in San Francisco roadway caused her to crash, fracture wrist

SAN FRANCISCO – A cyclist alleges her wrist was fractured in a fall from her bike she claims was caused by debris in a lane.

Trisha Griffard filed a complaint on May 16 in the San Francisco County Superior Court against city and county of San Francisco, Tutor Perini Corp.-Civil West and Does 1 to 100 alleging negligence and premises liability.

According to the complaint, the plaintiff alleges that on April 28, 2017, she was riding her bicycle westbound on Townsend Street when she crashed while riding through a construction zone created and maintained by the defendants. The plaintiff alleges that debris was strewn about the portion of the roadway and no warning was out.

The plaintiff holds the city and county of San Francisco, Tutor Perini Corp.-Civil West and Does 1 to 100 responsible because the defendants allegedly created the dangerous condition or had actual and/or constructive notice of the dangerous condition but did not put out any warning signs.

The plaintiff requests a trial by jury and seeks judgment for damages according to proof, plus costs of suit, and such relief as is fair, just and equitable. She is represented by Gunter Mihaescu of Law Office of Gunter Mihaescu in Oakland.
