Woman alleges La Daga Investments bought properties, failed to assume loans

FRESNO – A former owner of two properties in Selma alleges the buyers did not assume the loans as she was led to believe.

Mary Perales filed a complaint on May 17 in the Fresno County Superior Court against Rene Esquivel, La Daga Investments LLC and Does 1-20 alleging breach of contract, negligent misrepresentation and other counts.

According to the complaint, the defendants approached her to purchase her two properties in Selma to help her avoid defaults under the deeds of trust and promissory notes. She alleges the defendants did not assume the loans and that one property was sold without paying off the loan or the plaintiff.

The plaintiff holds Esquivel, La Daga Investments LLC and Does 1-20 responsible because the defendants allegedly falsely represented they would purchase the properties in exchange for assuming the loans.

The plaintiff requests a trial by jury and seeks judgment against defendants for general, actual, compensatory, punitive and treble damages; rescission of the agreement; costs of suit; attorney's fees and costs; interest; and further relief as the court may deem just. She is represented by Brian K. Cuttone and Craig C.O. Waters of Cuttone & Associates in Fresno.
